 Post subject: Whinging neighbours.... any suggestions?

Yesterday I had a call from our neighbor complaining about the noise our peacock has been making the last few months. I did try to explain it had been mating season and things should quieten down from now on, I don,t think he was convinced. We live on rural acerage. 2 1/2acres with about 100 acrers f bush land behind us, he is our closest neighbour about 500mts away and we cannot see his house for trees. We have had Elvis for over a year now and he was not at all noisy for the first 9 months, quiet before the storm. I told him we have become very attached to him, the kids handfeed him every morning and we will not be getting rid of him. He threatened to go to the council.
Just wondering if anyone else has encountered a unhappy neighbour in regards to their peacocks and what did you do to appease the situation? What action can the council take if any? Any comments greatly appreciated. The guy clamis the noise is causing stress while he digs in the garden .... pleeeeeze!!!!!

I would have just said sorry we don't have a peacock...there must be some feral in the bushland behind you. ;)

Might be worth contacting council first and discussing the issue with a ranger...at least than you will know what you might be up against,but being classed rural I can only imagine they won't really care to much AND you are 500 metres from his property thats half a kilometre :shock: :shock:

Tell him to turn his hearing aid down whilst he is gardening :lol: :lol:

You poor thing, Tutty! Tell him to get a real problem.

I am on 2 acres and have a peahen that is calling a bit, and lots & lots of roosters that crow. I have always shut my roosters away at night out of courtesy, but now have too many young ones to shut up. I haven't had any complaints so far, but don't get on very well with my immediate neighbours so have been worried that there might be trouble one day.

Where do you live? I am in NSW, and keep meaning to ring my local council and find out if there are any rules regarding poultry/livestock on small acreages. Hopefully there are none!

500 metres is a long way away, so I'm sure he has no right to complain and that any reasonable council wouldn't do anything.

I suggest buying a Drumkit and a couple of big Marshall Amps , Mike your drumkit up and Everytime you see your neighbours car pull in the drive Jump on the drumkit and let rip , He'll soon learn how nice a Peacock sounds . ;) Good Luck .

I know someone that was spraying their peacock with water at night every time he made a noise to teach him not to crow (is that the right word?? :oops: ). It only took a few nights before it worked.

The noisy one roosts about 20mts up a gum tree so would need one hell of a super soaker to reach him! And that would require me to get up at all hours, the neighbour may need to get some ear plugs and a good dose of medicinal sleeping juice.

Well I can sympathise with you Tutty, the problem you will have is with the zoneing of your property, as quite a lot of councils do not allow peacocks or noisey roosters parrots etc on certain zoned areas so check this out even then you are not safe believe me, I live on 10 acres and because of new rules by local councilam being forced to move or get rid of my birds , though they have been kind and given me two years to do this so yes the council can cease your birds and force you to get rid of them Good luck

You had me worried too Tutty so I went on to our council website:

Birds

Residents are permitted to keep various types of birds on properties in Logan City, subject to maximum numbers, responsible management, and land area controls as outlined under Council's Local Law No 4 (Animal Management) 2002.

Residents wishing to keep more than the allowed number of birds must apply to Council for a permit to keep birds (pdf).

Requirements apply under Council's planning scheme and licensing laws for the keeping of certain numbers of birds.

Poultry
For residents of Logan as existed prior to 15 March 2008

Poultry cannot be kept on land with an area less than 600m2. Roosters are not permitted on land less than 4000m2.

A maximum of six poultry may be kept on land that is between 601m2 and 1200m2. A maximum of 12 poultry may be kept on land that is between 1201m2 and 2000m2, and a maximum of 20 poultry may be kept on land that is more than 2001m2.

Additional numbers of poultry may be kept, provided an Application to Keep Poultry (pdf) is granted by Council.

For residents of Beaudesert as existed prior to 15 March 2008

No rooster over six weeks on less than 2100m2 or with adjoining premises less than 2100m2.

For residents of Gold Coast as existed prior to 15 March 2008

A permit is required to keep birds to which this division applies if more than six birds are kept on land with an area of more than 800m2 but less than 4,000m2.

Large birds
Large birds such as emus and ostriches are not permitted to be kept in Logan City unless development approval is gained and a licence issued for that activity.

Owners and keepers of birds, including poultry, have a number of responsibilities, including:

preventing waste waters and run-off from enclosures becoming a nuisance or health risk;
regularly collecting and disposing bird excreta, offensive material and food wastes;
supplying adequate shelter, water and food for the birds;
containing the birds in an enclosed cage or aviary;
sitting the cage or aviary at least two metres from property boundaries; and
suitably containing bird food.
Permits to keep additional birds / poultry
Permits to keep poultry in excess of the minimum allowed numbers will be assessed against the following additional criteria:

suitability of the proposed site or land;
suitability of proposed enclosures;
likelihood of the creation of nuisance, inconvenience or annoyance to occupiers of adjoining properties;
possible amenity impacts to the surrounding area; and
likely effect on the local environment and possibility of pollution or other environmental damage.
Council may revoke permits where conditions of the permit or standards of the local law are not being satisfactorily complied with.
