On another point plants can be trade maked - different to breeder rights. Trade marking simply means to sell it as a certian name then you have some rights to it, mabey if people wanted to sell a line for more for whatever reason they can use a TM.

That way people know they are buying the 'right' line in their eyes, and not sold an inferior product.

Not that i am saying anyones are inferior to others.

If that makes sense.

infact I have heard that some wish to TM colours/names
Will that mean that no one else can use the name?
Would that be possible if more than one can claim input or a parrallel program?
This is where the Credit Question come into it.
First published? first shown? etc as in my first post
How does it work in flowers?
In science its basically first published
or patents applied for
Where I currently am (PNG) there are no copyrights. Hence Harry Potter movies were here months befor Australia, and theres very few cinima chains

In plants the breeder who has the stock and its full history has to approach the governing body. Usually everything is studied about the plant, and it is then 'put through the paces' to test it for climate differences ect.

It is a VERY VERY expensive process. Thats for the breeder rights.

For trade mark It means, only people who have a liscence can propergate that particular plant and sell it under its marketed name. The TM will be the name promoted through tha magerzines ect.

I could propergate the wollomei pine, without problems of infringing on the rights, i would have to sell it under its boptanical name rather than its TM name of wollemi pine.

I think it would be a waste in poultry, but i feel if it did go down that path, it would be nicer of people to use a Tm rather than breeder rights. Breeder rights prevent it been breed by everybody - TM enables others to breed just not sell it as that name.

It is a tricky point as to who had it first, if TM was used, at least people could fr instance say its pink breeder a (example), and the next person who came along could call it pink breedr b. So the colour is the same, but it has a breeders name distinguishing the history/line.

It is all hypherthetical, and i think it would be sad for poultry to end up in a situation like this.

it would be a shame, Unfortunately I have little faith in humans & none in business's to do what we would deem fair
I work for companies that rape & pillage the 3rd world and its peoples.
I see what the people do to each other as well.

If there is any possible shred of "prestige" to be gained or 15 min of fame
for someone, in this day and age - then someone will do it.
Ive already heard "rumours" of groups looking to TM in the near future

Thats why I started the Topic, to gauge reaction
Seems like it would be a whimper of protest if at all
The modern day fancier is to comfortable & complacent to take interest in the future development of the fancy it seems
Almost no legislation is challenged today
Seems Mr Orwell will be right in the end he just got the date wrong

None of the true old time breeds who spend the last 40+ years breeding the modern day chook colours would care about trade marks they are the quite achievers like Clive Claus who also bred Lavender Pekins they don't need their 5 minutes of 'fame' or to constantly tell people they bred this or that they just do it. if 'a' person needs their little spot light I suggest they get one of those stupid little round badges that you pin on a shirt, you know the ones, they were popular with the hippies in the 60's and these days only come out to embarrass people on a 50th birthday and end up in the bin because you wouldn't be seen died wearing one.

Clive had great blues and other great colours as well
Ive seen a few of them over the years
Cant recall lave or millefluer in the last 20 odd years although I saw pics about a few year ago of a nice little blue from his lines mis entered as a lav- at the mathews memorial show i think it was
when do we see yours Drew?

Joanne, Think they are only sold in joke shops or found on the tip, best place for them :-D

mathews memorial show just a short drive down oops I mean up :-D Clive's been breeding Lavenders for more years than I can remember & I have a memory like a bull :-D When do we see yours "Dave"? still waiting

Ive never owned a lavender Drew or a millefluer.
Unlessyou count speckeled sussex,
Never claimed to have bred them, unlike yourself, whom has yet to show a single picture but oft claim
I have had however sussex,Malay sebright, gold & silver, campine, both colours, indian L&B and the usual.
ive had a few of lots over the years, and still to"claim" a line of anything
So tell me what you would like to see
Ill be back in country next fortnight
Ill put up, lets see yours
Or havnt you taken a picture yet?
