It's a difficult one as most Council's have different policies as Buggsy wrote but under offensive noise from our study of 2 councils it's not a black and white issue. The complaintiant must show the noise keeps occurring or continues to such a degree that it unreasonably disturbs neighbors (repeated over an hour). The council can investigate to substantiate the complaint. This may include collecting evidence such as written statements from neighbors, asking the complainant to keep a diary of when the noise occurs, and visiting the property where the bird is kept. In one instance in a Brisbane suburb the Council tried all avenues to have the Peafowl removed but they did not count on the owner taking court action to prevent the removal. In short the owner one but at a cost$$$ Good luck with the neighbors’.

Thanks for everyones advise and wisdom on this touchy topic. As I said in the previous entry the peacock "Elvis" has now quitened right down and we hardly ever hear him call , once or twice a day if that. Pam the neighbour who is interested in the chicks (hasnt got any yet) is a Sri Lankan man who recounts tales of his childhood in southern Sri Lanka where great flocks of wild peacocks followed the elephants eating insects distrubed by their passing. He lives on 20 acres of replanted rainforest and lots of bamboo along the creek bed. He loves the sound of the peacock as it takes him back to his childhood. I could not think of a person who would appreciate the magnificant birds any more than this man. No further complaints from the whinger, and I have asked every other neighbour in the immediate area and no one else has any problem with Elvis. So hopefully no more problems for the moment.

I suggest buying a Drumkit and a couple of big Marshall Amps , Mike your drumkit up and Everytime you see your neighbours car pull in the drive Jump on the drumkit and let rip , He'll soon learn how nice a Peacock sounds . ;) Good Luck .

That was very funny.

Imagine what the guy would be like if he was living in town (or the inner city!!) with neighbours living in close proximity.

500 metres! He needs to get a life.

I would contact council and lock peacock in at night

Agree with comments of Pam and P.A.

(speaking generally and I have not checked the legislation ) In noise complaints the council just can't come along and force you to get rid of your peacock based on one complaint from one neighbour (see comments from PA above). Or if they did I would assume very strongly that you would have some right of appeal to the courts.

Good luck. I had problems with a bastard neighbour who threatened my cats.

I ended up building a cat run and only have them out when I am at home and nasty neighbour cant harm them (as he has threatened).

I think as animal lovers we need to take responsibility for the animals we own and love. V much agree with Pam (re not trying to piss him off even more by giving young chicks to other neighbour). He might be unstable and develop some sort of obsessive hatred of peacocks if the noise really does drive him batty. And untimately harm them in some way.

I must admit I had a laugh when I first read the bit about giving the chicks away (but Pam is right) and it reminded me of some guys in sydney who had a neighbour who complained about one of the CD'S they played too loud.

Anyway the neighbours move out (the ones with the noisy CD) and so the complainer was happy. The only problem was the noisey CD neighbours told the new neighbours of the complaining neighbour and gave them as a housewarming present the CD (which the complaining neighbour hated!). I thought that was pretty funny.

Amazing how people whindge about them when they only make noise for 3 or 4 months of the year, what about idiots with motorbikes that ride around all weekend

My neighbours only complained once about mine then decided it was better that very loud rap music all day and withdraw their complaint and have not said a word since

I have lightly skimmed posts that are not 'regulation' based as at the end of the day one neighbour can cause a LOT of grief

a few years back I was taken to the Supreme Court - yes you heard right!!!! all because the nearest neighbours [remembering this was a vacation house and only used 2-4 weeks a year [how rich were they!!] didnt like hearing roosters - well I was fortunate that my Council was on my side and I won and was allowed an extra 15 birds :-D

but I digress

it all comes down to knowing in detail [including the fine print] your local Council AND your State AND the Federal guidelines/rules/regulations
as at the end of the day one always over rules the other

Some of the council regulations are so complex its almost impossible to work out what is or is not allowed. I got advice from a solicitor before I looked at any action
